Refugee Claim in Canada

A refugee claim is a formal request for protection in Canada by individuals who fear returning to their home country due to persecution, violence, or serious harm. Canada upholds international obligations under the 1951 Refugee Convention to protect those who cannot return home safely.

Eligibility

Eligibility for Refugee Protection

You may be eligible to make a refugee claim in Canada if:

  • You are inside Canada or at a port of entry (airport, border, or seaport).

  • You face a well-founded fear of persecution due to race, religion, political opinion, nationality, or membership in a particular social group.

  • You are not recognized as a refugee by another country and are not subject to criminal or security inadmissibility grounds.

Certain limitations apply under the Safe Third Country Agreement (STCA), particularly for individuals entering from the United States unless they meet an exception.

Refugee Claims Inland

If you are already inside Canada, you can submit your refugee claim online through the IRCC Portal.
You will need to prepare all supporting identification documents, explain your reasons for seeking asylum, and provide a complete Basis of Claim (BOC) form.

Basis of Claim (BOC)

The Basis of Claim form is the foundation of your refugee application. It describes why you fear returning to your home country and provides personal details, past experiences, and reasons for seeking protection in Canada.

You must submit your completed BOC form:

  • Within 15 days if your claim was made at a port of entry, or

  • Along with your online application if you are claiming asylum from within Canada.

Each family member making a claim must provide their own BOC form. Our professionals assist you in drafting and translating your story clearly and consistently to strengthen your application.​

Refugee Hearing (RPD)

After your claim is referred, the Refugee Protection Division (RPD) of the Immigration and Refugee Board (IRB) holds a hearing to determine if you qualify for refugee status.

At your refugee hearing:

  • A Member of the IRB listens to your testimony and reviews your BOC form.

  • You and your lawyer or representative will present evidence and answer questions.

  • The hearing is private and not open to the public.

Protected Person Application

A Protected Person is someone recognized by the IRB or IRCC as being in need of protection or as a Convention refugee. Once approved, you may apply for Permanent Residence in Canada through the Protected Persons program.

To qualify, you must:

  • Have received a positive decision from IRB or IRCC, and

  • Not hold citizenship or permanent residence in another safe country.

Pre-Removal Risk Assessment (PRRA)

If you are facing a removal order from Canada, you may still be eligible to apply for a Pre-Removal Risk Assessment (PRRA). This is your last opportunity to demonstrate that returning to your country would expose you to persecution, torture, or risk to life.

An IRCC officer carefully reviews your case based on new evidence or changed circumstances in your country.
Individuals accepted through PRRA are often granted Protected Person status, allowing them to remain in Canada and eventually apply for permanent residence.​
